Defective Timer- $27,200,000 - Pretrial Settlement

       Our team represented a 23- month old child who was shocked byan electrical timer, causing him to suffer brain damage and spastic quadriplegia.  This was, at that time, the largest pretrial settlement ever obtained in the 9th judicial district comprising the five counties, Westchester, Rockland, Putnam, Orange and Dutchess, and remains to this day on of the largest such pretrial settlements.  The settlement included both initial lump sum cash and future annuity payments to provide for our client's care throughout his life.

Defective Cooking Range- $17,500,000 Settlement During Trials

       Our team represented a mother, aged 24 and her two infant children, one aged three, the other one and a half, who were seriously burned when a pot with boiling water fell off an unsteady stove.  The landlord was sued for not properly maintaining the stove.  The settlement included both cash up front payments and annuity payments for life of all three plaintiffs.

Pedestrian Struck by Car- $5,900,000- Settlement During Trial

        Our team obtained a settlement with a value of $5,900,000 for a man who was struck by another vehicle on a highway, after he exited his disabled vehicle and remained on the roadway.  His injuries resulted in a below the knee amputation of one of his legs.  His claim included compensation for the effect on his life.  The settlement included both initial lump sum cash and future annuity payments for the rest of his life.

Pedestrian Struck by Truck- $3,900,000 Pretrial Settlement

       Our team successfully represented a 22 year old blind woman who was struck by a truck as she was crossing the street.  She sustained a crushing and de-gloving injury to her right hand, which affected her ability to communicate and read Braille.  The settlement included both initial lump sum cash and future installment annuity payments for life.

Failure to Timely Diagnose Cancer- $3,400,000- Pretrial Settlement

       Our team represented two surviving daughters of a 42 year old woman, a smoker, who died of lung cancer.  Our attorneys proved that the woman's surgeon failed to properly read her chest x-rays or send her for follow-up testing, delaying the ultimate diagnosis of her lung cancer.  The settlement included both lump sum cash payments and future annuity installment payments to pay for the two surviving children's educational and other maintenance expenses for the rest of their lives.

Scald Burn- $3,400,000 Settlement During Trial

       Our team obtained a settlement on behalf of a 32 year old epileptic deaf mute woman who was scalded while bathing in her bathtub.  She suffered second and third degree burns over 30% of her body.  Her claim was solely for pain and suffering.  The settlement included both initial lump sum cash and future annuity payments for life.

Motorcycle Accident- $3,100,000 Pretrial Settlement

        Our team represented a 23 year old motorcyclist who was struck by a private ambulance that ran a red light while on a non-emergency call.  He sustained a fracture of one of his lower legs requiring insertion of a rod.  The settlement included both initial lump sum cash and future annuity installment payments for life.

Scald Burn Case- $2,500,000- Pretrial Settlement

       Our team represented a 75 year old woman who suffered second and third degree burns to 25% of her body from scalding water while showering in her apartment.  The action was brought aquastat.  As a result of her injuries, the client was confined to a nursing home.  The recovery included a negotiated reduction of the Medicaid lien, increasing the net amount payable to the client.

Construction Accident- Falling Elevator- $2,000,000- Pretrial Settlement

       Our team won a settlement for a 50 year old construction worker who was working in a townhouse that was being rehabilitated.  The townhouse elevator fell several stories causing our client to suffer a spinal compression fracture and fractured shoulder.  The claim included compensation for both pain and suffering as well as out of pocket damages including wage loss and involved resolution of an outstanding Worker's Compensation lien.

Woman Struck by Two Cars- $1,800,000 Settlement During Trial

       Our team obtained a settlement with a value of over $1,800,000 for a 61 year old woman on her way to a defensive driving class who was struck by one vehicle, and while lying on the road waiting for help to arrive, was run over by a second vehicle.  She sustained multiple fractures, including a fractured left hip, fractured left femur, fractured tibia and fibula requiring multiple surgeries.  The settlement included both initial lump sum cash and future annuity installment payments for life.

Defective Rental Car- $1,015,000 Settlement

       Our team represented a 61 year old businessman who was involved in an accident when his rented car went off the roadway and struck a tree.  We successfully established that the car had a problem with the steering system.  As a result, we negotiated a settlement with a value of $1,000,000.  In addition, we obtained a payment of underinsured motorist benefits from the vehicle's insurance policy, as well as negotiating a reduction in the Worker's Compensation lien.

Defective Coffee Pot- $1,000,000 Verdict- Affirmed by Appellate Courts

       Our team represented a two year old child who was scalded by boiling hot water when a coffee pot cracked and broke open, showering him with boiling water.  Our team proved that the manufacturer knew or should have known of the potential for defects during the manufacturing process, but had taken no remedial action.  This verdict was among the first million dollar verdicts in the entire United States and the first in a products liability case in Bronx County .

        Our team has successfully concluded cases on behalf of the surviving family members resulting from recent airline crashes.  We have represented the estates of many passengers on each of Flights TWA 800 and American Airlines 587.  The settlements, which were in confidential amounts, resulted in very substantial payments to the surviving family members for the loss of their loved ones.
